Complaints

If you have a complaint please let us know as soon as possible. We suggest you either call us on +44 (0)1372 371093 or email: info@onlinewinecourses.com. Please put in the subject header COMPLAINT and quote your customer reference number. You will receive confirmation of your complaint within 72 hours and it will be dealt with by an assigned member of staff. We aim to resolve any complaint within 5 working days.

Academic Appeals

Should you have a complaint about any of the examination questions or you would like to appeal against your examination result, you must do so in writing within 7 days of completing the exam. Please contact us by post or email. If you have passed the examination you will need to post the print out of your exam result to: Vintellect Ltd, Fetcham Park House, Lower Road, Leatherhead, Surrey KT22 9HD.

Our email address is info@onlinewinecourses.com. Please put in the subject header EXAMINATION APPEAL. You will receive confirmation of receipt your appeal within 72 hours and it will be dealt with by an assigned member of staff. We aim to resolve any appeal within 5 working days.

Delivery

Please let us know if your order is required by a certain date and we will do our very best to ensure you receive it in time. Allow 3-7 Days for Europe and 3-10 days for the rest of the world.

Returns

Our returns policy. If you are unhappy with your purchase (if the item is faulty, damaged or defective) you must notify us by email and return the good/s to us in its/their original condition, within 10 calendar days of receipt, for a prompt replacement, exchange or refund. You are responsible for postage costs on returned items. It is your responsibility to make sure that all returned items are packed and posted carefully to avoid any damage.

VINTELLECT LIMITED END USER LICENCE AGREEMENT

Website copy ("Licence")

Please read this document carefully before purchasing/downloading, one of Vintellect's courses, either 'Max Your Wine Sales' course or 'Max Your Wine Knowledge' course (both referred to as the "Course"). This is a contract which applies to each version of Vintellect's wine courses. By purchasing/downloading the Course you are agreeing to be legally bound by the terms of this licence. If you do not agree to the terms of this licence you will be unable to purchase/download the Course.

Grant of Licence

This licence shall be between Vintellect Limited ("Vintellect") and any person using the Software or the Materials ("You").

The Course contains proprietary data and application and/or system software ("the Software") and related documentation and other materials in printed or electronic form ("the Materials") which are owned by Vintellect and/or licensed to Vintellect. Vintellect or Vintellect's Licensors retain title in the Software and Materials. This Licence allows You to use the Software and Materials on any one single computer.

Vintellect hereby grants You a non-exclusive licence to use the Software and the Materials for a period of 1 year for 'Max Your Wine Sales' and indefinitely for 'Max Your Wine Knowledge'.

In the event that You wish to use the Software on an alternate computer You must completely remove all trace of the Software from the first computer. For the avoidance of doubt under no circumstances shall the Software be used concurrently on more than one computer.

FAILURE TO COMPLY WITH AND ADHERE TO THE TERMS AND CONDITIONS OF THIS LICENCE COULD SUBJECT YOU TO LEGAL ACTION BY VINTELLECT AND/OR VINTELLECT'S LICENSORS.

Intellectual Property Rights

Intellectual Property Rights shall mean the copyright, design rights, database right, patents and any rights to inventions know-how, trade and business names, trade secrets, logos and devices, trade and service marks (whether registered or unregistered) and any applications therefore and all rights in confidential information on a worldwide basis.

All such Intellectual Property Rights in the Software and the Materials including without limitation images, photographs, animations, video, audio and text incorporated into the Software vest in and shall remain the property of Vintellect and/or its Licensors.

Restrictions

You are expressly prohibited from copying, duplicating, reproducing or otherwise transferring the Software and Materials (or any component thereof) for any purpose whatsoever other than as permitted by this Licence and not make any copies of the Software for back-up purposes or otherwise.

You may not decompile, reverse engineer, disassemble or otherwise reduce the Software to a human perceivable form.

You may not modify, merge, adapt, translate, rent, lease, loan, sell, distribute or create derivative works based on the Software and Materials in whole or in part except where Vintellect expressly authorises you in writing to do so.

You may not electronically transfer the Software and Materials from one computer to another over a network.

You may not use the Software or Materials for any illegal or immoral purpose.

You may not load and store the Software or Materials on more than one computer hard drive and shall not load and store the Software and Materials on any other data retention device.

Warranty on Media (Applicable to the CD version only)

Vintellect warrants the CD-ROM compact disk on which the Software is recorded to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of dispatch as may be evidenced by records of such dispatch.

Vintellect warrants that the CD-ROM compact disk on which the Software is recorded to be free from virus upon dispatch however Vintellect does not warrant that the disk shall remain virus free and you acknowledge that viruses are a common hazard of modern computer use and as such once installed You should take adequate measures to protect your computer system.

Vintellect's entire liability and your exclusive remedy will be the replacement of the disk not meeting Vintellect's limited warranty and which is returned to Vintellect with a copy of the receipt or other proof of authorised possession.

Vintellect will have no responsibility to replace a disk damaged by accident, abuse or misapplication.

Disclaimer of Warranty and Liability

You expressly acknowledge and agree that the use of the Software and Materials is at your sole risk. The Software and Materials are provided "AS IS" and without warranty of any kind. Vintellect and Vintellect's Licensors expressly disclaim all warranties, express or implied, to the fullest extent permitted by law.

Vintellect and Vintellect's Licensors do not warrant that the functions contained in the Software will meet your requirements, or that the operation of the Software will be uninterrupted or error-free, or that the defects in the Software and/or the Materials will be corrected. Furthermore, Vintellect and Vintellect's Licensors do not make any representations regarding the use or results of the use of the Software or Materials in terms of their correctness, accuracy, reliability, or otherwise.

No oral or written information or advice given by Vintellect, Vintellect's Licensor's or an authorised representative of Vintellect and/or Vintellect's Licensors shall create a warranty or in any way increase the scope of this warranty.

Vintellect does not warrant that the use of the Software and/or Materials will not infringe the intellectual property rights of any third party. If You are unable to use the Course without infringing the intellectual property rights of a third party, Vintellect may at its discretion, subject always to the availability of a licence of such intellectual property rights either:-
pay any licence fee demanded by a third party for the use of the Course; and/or
terminate the Licence and refund the purchase price to You.

Under no circumstances including negligence shall Vintellect or Vintellect's Licensors be liable for incidental, special or consequential damages that result from the use or the inability to use the Software or Materials, even if Vintellect, Vintellect's Licensors or an authorised representative of Vintellect and/or Vintellect's Licensors have been advised of the possibility of such damages.

In no event shall Vintellect or Vintellect's Licensors total liability to You for all damages, losses, and causes of action (whether in contract tort (including negligence) or otherwise) exceed the amount paid by You for the Course PROVIDED THAT Vintellect and/or Vintellect's Licensors do not seek to exclude or restrict their liability for death or personal injury resulting from their negligence.

WHERE YOU HAVE PURCHASED THE COURSE AS A CONSUMER THIS CLAUSE IS IN ADDITION TO AND SHALL NOT BE TAKEN TO EXCLUDE YOUR STATUTORY RIGHTS.

Termination

In the event of Termination of the Licence, the Software and Materials and all copies thereof must be destroyed.

The Licence will terminate immediately without notice from Vintellect and/or Vintellect's Licensors if You fail to comply with any provision of this Licence. On termination You must destroy the Software and Materials.

You may terminate the Licence at any time by complying with the provisions of clause 6.1.

Controlling Law and Severability

This Licence shall be governed by and construed in accordance with the laws of England and You agree to submit to the jurisdiction of the English Courts.

If for any reason a Court of competent jurisdiction finds any provision of this Licence or portion thereof to be unenforceable that provision of the Licence shall be enforced to the maximum extent possible so as to effect the intent of the parties and the remainder shall continue in full force and effect.

Entire Agreement

This Licence constitutes the entire agreement between the parties with respect to the use of the Software and Materials and supersedes all prior understandings or agreements written or oral regarding such subject matter.

Assignment

This Licence may not be assigned or sub licensed by You. Vintellect may assign its rights under this Licence without notice to You. The Contracts (Rights of Third Parties) Act 1999 is expressly excluded from this Licence save for those rights arising in relation to Vintellect's Licensors.

Inspection

Vintellect and/or Vintellect's Licensors or any of its duly appointed agents shall have the right at any time to inspect your premises to verify that Your use of the Software and/or Materials is in accordance with this Licence.
